Your privacy is important to us. We want to process your personal data in an honourable, legal, correct and transparent manner. In this document, our privacy policy, we explain how the processing is carried out and what personal data is involved. The term processing includes the following: collection, recording, organisation, storage, updating, modification, retrieval, consultation, use, dissemination or making available in any way, compilation, combination, archiving, deletion or eventual destruction.

We are talking about you as a (future) customer of our company, a supplier or a data subject of an organisation that is in contact with us.

LAPAUW INTERNATIONAL (BE 0437.144.653) and WERKHUIZEN LAPAUW (BE 405.349.340) are active throughout the world and address other companies. The registered office is located at Oude Ieperseweg, 139 in 8501 Heule.

This privacy policy applies to both companies and they are jointly responsible for the processing of your personal data.

When we refer in this policy to "we", "our", "name of the group", we are clearly referring to the group of companies, as explained above.

Your right to privacy

You have many rights regarding the processing of your personal data.

The implementation of your rights in our systems and procedures takes place within 30 days after we have received your request. If for some reason this deadline cannot be met, we will inform you before the expiry of the original period.

You are allowed to check your personal data

You have the right to know what personal data we process about you, the purpose of the processing, where we have obtained the data and who receives the data.

In this case, you can also find out how long we keep the data, whether the data is used for automated decision-making and whether we intend to transfer the data to a country outside the European Union.

You can place this application free of charge twice a year with an interval of at least 6 months between the two applications. In all other cases this request is considered excessive and inconvenient and LAPAUW may charge a fee of € xxx per request.

We provide you with the requested information in writing or electronically within a reasonable period of time.

You can have your data corrected/updated

It may happen that the data we process about you is not or is no longer correct. You can always ask to have the incorrect data corrected or supplemented with the missing data.

Right to erase

If you believe that we are unlawfully processing personal data you may request that this personal data be deleted.

This request to delete personal data can be refused by LAPAUW when this is justified. Examples are the exercise or substantiation of a legal claim or because of a legal obligation to retain certain data.

Right to restrict personal data

You can ask us to limit the processing of your personal data if you suspect that the data is incorrect, the processing is unlawful or if you do not agree that we process the data under our legitimate interest (see article 3.3). We will comply with this objection unless there are compelling reasons not to do so, for example, to prevent fraud or non-payment.

The right to object

You have the right to object to the processing of your personal data, including profiling. The processing will then be stopped, unless it is necessary for compliance with social and fiscal legislation, to protect the interests of a third party or for the establishment, exercise or substantiation of a legal claim.

Right to data portability

You can contact us to request that the personal data you have given us be transferred to a third party.

Right to lodge a complaint

If you do not agree with our position, you can contact the Belgian Data Protection Authority, where you can also lodge a complaint. You will find the contact details above in section 1.4.

Identification of the applicant

You can exercise your rights concerning the processing of your personal data by making a written request

Always be as specific as possible when you want to have your rights exercised. This will allow us to exercise your request correctly.

In order to prevent someone else from exercising your rights, we want to check your identity as closely as possible. Therefore, the application must always be accompanied by a document that proves that the identity of the applicant corresponds to your identity. You can do this by attaching a copy of your identity card to the application. Please make sure that your passport photo and identity card number (etc.) are blacked out, to protect your privacy.

If we are of the opinion that the document provided is insufficient proof, we will inform you. We reserve the right not to accept the application until sufficient proof has been provided.

Why wo we want to process your personal data

LAPAUW must comply to legal obligations

In some cases, we are legally obliged to process your personal data. Here are the most important ones:

- tax law

- commercial law

- We may be forced to provide personal data to authorities or other third parties. For example, if this is necessary in connection with a legal obligation or to carry out a task of public interest.

LAPAUW must be able to fulfil his contract with you

As a customer with us, you make use of our services or buy our products. In order to ensure the proper execution of our contract we must process and manage these contracts administratively, accounting-wise and operationally.

This also applies if you are a supplier of LAPAUW. In this case, too, we must respect the contract and we must process and administer the supplier contracts administratively, financially and operationally.

When you visit our website we make an agreement that we will always provide you with a properly functioning website. For this purpose we place so-called functional cookies.

LAPAUW must be able to function as a company in terms of direct marketing and communication

As a commercial enterprise we have a number of legitimate interests that form the basis for processing personal data. In doing so we take care that a proper balance exists between your right to privacy and the legitimate interests of LAPAUW. In the event that you still have objections to the processing under this basic ground, you can lodge an objection to this processing.

LAPAUW wishes to continue to communicate with you, as an existing customer or active prospect, via direct marketing. This may be in response to your specific request or we may suspect that you are interested in our new products/services. Since our aim is to offer you better and better services and products and to communicate this to you by e-mail, we process your personal data for direct marketing under the legitimate interest of our company to do business. If you do not wish to receive our commercial communications, please let us know and we will stop harassing you.

LAPAUW asks for your permission

By subscribing to our newsletter, you give your implicit consent to receive information about our services/products. Every newsletter always contains an unsubscribe option.

When you visit our website for the first time, we ask for your permission to place our statistical, marketing and social media cookies via our cookie banner. You can find more information about our cookie policy here.

What personal data do we process from you and for what purposes?

From our business relations

Our business relations are our customers and suppliers. LAPAUW processes the personal data of those concerned who work for companies with which business is conducted. The purpose of this processing is to provide information about products and services and to maintain business relationships.

In order to contact and identify you, for our customer and supplier management we process the following data: Name, first name, address, nationality, telephone number, mobile number, language, e-mail address, IP address, cookies.

From potential customers

Our potential new customers are interested in our products and LAPAUW wants to keep them informed. In order to communicate with them, we process the following personal data: surname, first name, nationality, language, title of address, telephone and/or mobile phone number, e-mail address, IP address, cookies.

Cookies

LAPAUW uses cookies on the www.lapauw-international.com website. These are small information files that, when you visit the website, are stored on the device you use to visit our website, such as a computer, tablet or smartphone. Where we refer to "cookies" below, we also mean other similar techniques. Cookies make it possible to recognise your web browser. This is useful, for example, because it saves you from having to repeatedly enter your details, indicate preferences or change your settings. This also enables us to improve our website, to gain insight into visitor behaviour on the website and to give other parties insight into your surfing behaviour so they can show personalised advertisements across multiple websites and omit non-remarkable advertisements.

Cookies do not endanger the security of your computer.

We use functional, analytical, marketing and social media cookies. With the exception of the functional cookies (necessary for the proper functioning of our website) we ask your permission before we place these small information files. Footage from surveilance cameras is temporarily stored.

We may use cameras in and around our buildings. When it comes to surveillance cameras, we respect the legal rules. You will recognise the buildings under camera surveillance by a clearly visible sticker.

Image recordings are kept for a maximum of 30 days. Exceptions to this are

- if the recorded images are useful for proving a crime or nuisance

- to prove a loss

- to identify a perpetrator, a witness or a victim

Sharing and storing your personal dataWho do we share your data with?

We only share your data with persons who have received explicit permission from us, if they need this data in order to fulfil their tasks. These persons will process your data on the same basis as we have received them from you.

We use various processors for the processing of personal data. These are our subcontractors who carry out personal data processing on our behalf. LAPAUW works only with processors who guarantee the same security in technical and operational terms.

We share your data only in the event that we are obliged to do so by law or government order.

LAPAUW does not share your personal data

We do not rent or sell your personal data to third parties, so that they would use it for their own purposes

We do not store your data indefinitely

LAPAUW uses your personal data with a clear purpose in mind. When this purpose is achieved, the data are deleted.

The point of departure for the storage of your personal data is the legal retention period.

The personal data of prospective customers are initially stored for 3 years. If during this period there has been contact between the prospect and LAPAUW a period of 5 years starts again from this contact.

Our products are investment goods that have a fairly long life cycle. For this reason we retain the personal data of our customers and suppliers for a maximum of 15 years after the last purchase.
